These Terms and Conditions ("Terms") govern your access to and use of the website, services, platforms, and evaluation programs provided by Kukka Capital ("Company", "we", "us", or "our"). By accessing our services, you ("User", "you") agree to be bound by these Terms. If you do not agree, please cease using our services immediately.

1. Eligibility & Account Registration

  • Minimum Age: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services.

  • Account Accuracy: You agree to provide accurate, current, and complete information during registration and to maintain the security of your account credentials. You are solely responsible for all activities under your account.

  • Jurisdictional Restrictions: You are responsible for ensuring that accessing our services complies with the local laws and regulations of your country of residence.

2. Nature of Services & Risk Disclosure

  • Educational & Evaluation Purpose: Any evaluation models, simulated trading accounts, or challenges provided by Kukka Capital are intended for skill assessment and educational purposes. Unless explicitly stated otherwise in a separate agreement, simulated trading does not involve live financial markets.

  • Financial Risk: Trading in financial markets (including forex, equities, derivatives, and crypto) involves substantial risk. You acknowledge that you may lose part or all of your capital.

  • No Investment Advice: Kukka Capital does not provide investment, legal, or tax advice. All content, research, and analysis provided are for general informational purposes only.

3. Prohibited Trading Practices

Users are strictly prohibited from engaging in manipulative or unfair trading practices, including but not limited to:

  • Exploiting system latency, software vulnerabilities, or feed errors.

  • Engaging in coordinate trading across multiple accounts or with third parties.

  • Using high-frequency trading (HFT) or automated bots designed to manipulate simulated environments.

  • Reverse engineering any proprietary platform or software provided by the Company.

4. Intellectual Property

All content, trademarks, logos, software, and proprietary systems visible on our platform are the exclusive property of Kukka Capital. You are granted a limited, non-exclusive, non-transferable license to access the platform solely for personal, non-commercial use as permitted by these Terms.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Kukka Capital and its affiliates, directors, or employees shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to trading losses, loss of profits, or data corruption arising from your use or inability to use our services.

6. Termination

The Company reserves the right, at its sole discretion, to suspend, terminate, reject payouts, void profits, or permanently close any account that is found to violate these Terms, engage in abusive trading practices, fraudulent activity, or attempt to circumvent the evaluation process.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in United Kingdom.
